Shanghai's Huangpu district has resolved a trademark infringement dispute involving Warner Bros Entertainment and a local company through a combination of administrative and commercial mediation.

The case began after Warner Bros reported that the company had organized paid Harry Potter-themed parties and promoted them online without authorization. Although the events used licensed merchandise, the commercial use of Harry Potter trademarks to promote paid services risked misleading consumers about whether the activities were officially authorized.

Huangpu's intellectual property administration investigated the case, established the infringement, and imposed an administrative penalty. It then facilitated mediation between the parties, bringing in commercial mediation bodies to help negotiate compensation amounts and payment arrangements.

The dual-track approach combined administrative authorities' role in clarifying legal responsibilities with commercial mediators' expertise in resolving practical disputes. The process resulted in a civil compensation agreement, helping address the rightsholder's losses while allowing the company to correct its practices and improve compliance awareness.

The approach also reduced the time and costs associated with cross-border intellectual property enforcement, including potential notarization, authentication, and litigation expenses.

Huangpu said it will strengthen coordination with mediation and arbitration institutions to improve collaborative intellectual property protection and support the district's commercial development.
