Institutional functions
(1) Implement the laws, regulations, rules and policies on intellectual property, or IP work. Research and draft local regulations and rules on IP aspects – such as patents, trademarks, geographical indications of origin and layout designs of integrated circuits, formulate relevant policies and organize their implementation.
(2) According to the overall requirements of the country, together with relevant departments, formulate the outline of IP powers and an IP development planning and work plan, as well as organize their implementation. In accordance with the authority, together with relevant departments, guide, supervise and evaluate the implementation of the outline of IP powers in various districts. Promote the regional coordinated development of IP.
(3) Responsible for IP protection work and promote the construction of an IP protection system. Implement the protection system for IP in such areas as patents, trademarks, geographical indications of origin and layout designs for integrated circuits. Responsible for business guidance on law enforcement work in such areas as patents and trademarks. Responsible for administrative adjudication-related work in patent infringement disputes. Responsible for IP dispute mediation, dispute resolution, rights protection assistance and other work. Responsible for the formulation of a key trademark protection list and the declaration of geographical indication products of origin.
(4) Responsible for daily supervision of IP such as patents, trademarks, geographical indications of origin and layout designs for integrated circuits. Organize and carry out patent agency management work. Responsible for supervision work related to patent and trademark agencies and irregular patent applications, malicious trademark registrations and illegal use and publicity of well-known trademarks. Coordinate and promote the supervision of credit-based graded classifications in the field of IP rights and organize relevant inspection work.
(5) Responsible for promoting the use of IP rights. Formulate policies and measures to promote the creation, use and management of IP rights and standardize IP transactions and organize their implementation. Promote the transfer and transformation of IP rights. Guide and standardize the transfer, licensing and filing of patent rights and trademark rights. Together with relevant departments, carry out reviews on the transfer of IP rights to foreign countries. Promote innovation in IP financial services and standardize IP evaluation work. Guide market entities to carry out the comprehensive operation of relevant IP rights and promote civil-military integration development in relevant fields of IP rights.
(6) Responsible for promoting the construction of an IP public service system. Build and manage a convenient enterprise-friendly and interconnected public service platform for IP information and promote the dissemination and utilization of IP information. Cultivate, develop and supervise the service industry for IP in such areas as patents, trademarks, geographical indications of origin and layout designs of integrated circuits. Together with relevant departments, carry out risk early warning work on IP. Guide the application and registration work of IP in such areas as patents, trademarks, geographical indications of origin, and layout designs of integrated circuits.
(7) Responsible for promoting the construction of an IP talent system. Guide and promote the construction of relevant talent teams and organize professional technical title evaluations for IP rights. Organize publicity and popularization of relevant laws, regulations and policies on IP rights.
(8) Coordinate foreign-related IP matters. Formulate policies on foreign-related work on IP rights. Study foreign development trends on IP rights, carry out international liaison, cooperation and exchange activities on relevant work on IP rights and handle matters related to Hong Kong, Macao and Taiwan. Promote the gathering of international resources on IP rights.
(9) Complete other tasks assigned by the Shanghai Municipal Party Committee and Shanghai Municipal Government.
