Shanghai adheres to the principle of "led by the market and guided by the government". The city actively carries out the transformation and application of IP, and promotes the realization of IP value in multiple ways. Shanghai strengthens the guidance of IPR utilization, gives play to the demonstration effect of the China Patent Award, China Trademark Gold Medal and the Shanghai Intellectual Property Innovation Award, supports innovation entities in increasing the use of IPR, promotes the construction of transaction and operation functional platforms, sets up special funds for IP operations, accelerates the training and introduction of high-end talents in IP operation, cultivates IP operation and service institutions, and has initially established a relatively complete ecological system for the comprehensive utilization of IPR.
(1) Strengthen the orientation of high-quality development
Implement the guidelines on high-quality development of IP, establish indicators, policies, statistics and an assessment system which promote high-quality development, and implement patent quality improvement projects and trademark brand strategies. In 2019, the Shanghai government and WIPO jointly issued the Shanghai Intellectual Property Innovation Award for the first time, and nine units, including Commercial Aircraft Corporation of China, won the award for creation, protection and utilization.
Shanghai has won the China Patent Gold Medal 20 times (1989-2019) and five projects have won the China Trademark Gold Medal.
Brand development strategy. In 2019, Shanghai Intellectual Property Administration built 13 new trademark and brand guidance stations, bringing the total number to 37. The fourth and fifth batches of Shanghai municipal key trademark protection lists were issued. The Shanghai Municipal Commission of Economy and Informatization and the Shanghai Intellectual Property Administration jointly held the fifth China Brand Economy (Shanghai) Forum with the theme of "Global Perspective of Chinese Brand & Brand Economy ".
Intensify efforts to crack down on abnormal applications for IPR and patents. In 2017 and 2018, 1,235 abnormal patent applications were withdrawn, with a withdrawal rate of 94 percent. Five enterprises suspected of abnormal patent applications were given warnings and their patent subsidies were suspended.
In 2019, the National Intellectual Property Administration recognized 18 national IP advantageous enterprises and six IP demonstration enterprises in Shanghai. The municipal intellectual property administration recognized 93 pilot units and 33 demonstration units for patent work and two pilot and demonstration parks for IP in the city. The administration also supported five enterprises to carry out pilot projects on patent navigation, and five parks to carry out pilot projects on IP custody in parks. The local standards of Technical Guidelines for Intellectual Property Appraisal were formulated and issued, and the administration supported two units in carrying out pilot projects for IP appraisal.
In the past five years, 25 enterprises have won the honorary title of National Intellectual Property Demonstration Enterprise, and 64 enterprises have won the title of National Intellectual Property Advantageous Enterprise. A total of 827 units won the title of Shanghai patent pilot demonstration enterprises or units.
(2) Optimize the IPR operation system
Establish the service system for IP finance whole chain. Guided the pilot projects of IP securitization in Pudong New Area, and promoted the successful listing of ABS project on the Shanghai Stock Exchange with an issuance amount of 1 billion yuan ($140 million), thus achieving a breakthrough in IP securitization in Shanghai. Improved the IP financial service chain, and signed the Strategic Cooperation Agreement on Promoting the Intellectual Property Pledge Financing with 10 Banks. Guided the Shanghai Intellectual Property Service Center to lead the establishment of the Shanghai intellectual property financial service alliance. From 2017 to 2019, the Shanghai representative office of the National Intellectual Property Administration registered 233 patent pledge contracts, with a pledge value of 2.73 billion yuan. A total of 324 enterprises purchased patent insurance, with a total premium of 3.38 million yuan and a coverage of 145.44 million yuan.
Established the International Operation (Shanghai) Pilot Platform of the State Intellectual Property Operation Public Service Platform. The platform's entity enterprise – Shanghai International Intellectual Property Operation and Management Co Ltd – was established in November 2018 in Zhangjiang Science City. The enterprise started operations May 17, 2019.
The platform focuses on five core businesses: IP trading services, financial innovation, overseas distribution and IPR protection, key industry operations, and basic services. It has built an operating structure of "one body and two wings" with the enterprise as the main body, the Shanghai International Intellectual Property Operation Alliance and IP trading institutions as the support. In 2019, relying on trading institutions, the platform completed 85 scientific and technological achievements, and trading and service projects, achieved IP transactions and services worth 550 million yuan, and attracted 90 domestic and foreign institutions to join the Shanghai International Intellectual Property Operation Alliance.
